If Cohen wanted an effective inquiry hew would have established a truly independent staff of experts in fisheries science, management and enforcement. He would have provided funds for interveners to engage experts and to prepare evidence. Instead he has created a lawyers' picnic with a large staff of in-house lawyers and a corresponding cadre of government-funded lawyers acting on behalf of interveners.

According to Conservative MP John Cummins (Delta-Richmond East), ratification of the Yale agreement could seriously tie the hands of Chief Justice Bruce Cohen, who is in the preliminary stages of setting up a federal government-ordered judicial inquiry into the decline of Fraser River sockeye salmon.
This is a full inquiry, armed with witness-subpoena powers that many stakeholders had sought.
"Mr. Justice Cohen has to investigate the Fraser Canyon fishery and its impact on migrating sockeye," says Cummins, himself a one-time commercial angler.
"These treaties represent constitutional change, so if Justice Cohen decides changes need to be made in the canyon, then the Yale treaty will tie his hands before his hearing starts," Cummins adds.

Penner's response didn't sit well with MLA Michael Sather.
"It is interesting to note that, even though the Fraser River sockeye run was very poor overall, the Harrison River run was strong," said Sather. "Unlike the outmigration of juveniles of other Fraser River sockeye, which go north from the mouth of the Fraser, the Harrison run goes to sea via the Strait of Juan de Fuca, where there are no fish farms. The B.C. Liberals have been extremely loathe to regulate the fish farm industry, who contribute significantly to their party."
Bob McKamey, a representative of gillnet fishermen who requested the judicial inquiry, said, "This is the third year of disastrous sockeye returns."
He accused Fisheries and Oceans Canada of "epic mismanagement of Fraser River sockeye, which has been regularly covered up. It is long past time we got some honest answers. We don't have time to watch four more years of compromise and ass-covering from here to Ottawa," he said.
"It's no longer about who gets to fish. It's about the survival of Fraser River salmon," he said.

"DFO's epic mismanagement of Fraser sockeye has been regularly covered up and it's long past time we got some honest answers..... We've been calling for a judicial inquiry into DFO's management of Fraser salmon since 1992, but DFO always finds some way to avoid being accountable and now the department has destroyed 3 of the 4 cycle years of our once-magnificant Fraser sockey runs," said McKamey.
